Rehabilitation Overview

Rehabilitation is the process done for previously sequestrated individuals and brings an end to their insolvency. The circumstances in each case differ and will be assessed based on its circumstances, especially being influenced by the time lapse since sequestration and other circumstances. When rehabilitation is done, it places you in a position to start building up a good credit record afterwards. You can get your name cleared at credit bureaus without any need to appear in court.

The rehabilitation process involves bringing an application to the High Court asking the court to relieve the insolvent of every disability resulting from sequestration. It ends the sequestration and discharges all the insolvent’s pre-sequestration debts. The insolvent will automatically be rehabilitated after the expiration of 10 years, but can apply at court to be rehabilitated after 1 year under certain circumstances but usually after four years.
